The Regulations Governing Qualifications and Trainings of Professional Staffs of Child and Juvenile Welfare Institutes

Article 1
The Regulations Governing Qualifications and Trainings of Professional Staffs of Child and Juvenile Welfare Institutes are enacted pursuant to Article 51 of the Child and Juvenile Act (hereinafter “Act”).
Article 2
The professional staffs of child and juvenile welfare institutes (hereinafter “Institutes”) referred in the Act are defined as follows:
1. Educator or assistant educators: Staffs who educate and take care of children in nursery institutes.
2. Nannies: Staffs who look after children under two years old in nursery or placement and education institutes.
3. Early intervention educators or assistant early intervention educators: Staffs who educate and take care of children with development delay in early intervention institutes.
4. Child care staffs or assistant child care staffs: Staffs who take care of children’s daily life in placement and education institutes.
5. Life consulting staffs or assistant life consulting staffs: Staffs who take care of juveniles’ daily life and advise them regarding daily life matters in placement and education institutes.
6. Psychological consulting staffs: Staffs who provide consulting service to children and juveniles in placement and education institutes, psychological consulting or family consultation institutes or other institutes.
7. Social workers: Staffs who provide social work service, such as assisting children and juveniles’ entering and leaving institutes, visits, investigations and integrating resources, in nursery, early intervention, placement and education, psychological consulting or family consultation institutes and other institutes.
8. Superintendents: Staffs who are in charge of all the administrative affairs in Institutes.
Article 3
An educator shall meet one of the following qualifications:
1. Possessing an associate’s degree or a higher degree related to child education or child care or a minor degree related to child education or child care;
2. Possessing an associate’s degree or a higher degree as well as a certificate of preschool teacher programs or educator training programs;
3. Being a graduate of a general or vocational high school and possessing a certificate of Program B and C issued by the Training Programs for Professional Staffs of Child Welfare before the Regulations are implemented. The person with such qualifications shall be employed as educator within ten years from the date the Regulations are implemented.
4. Being qualified in junior examinations or other equal examinations for civil servants of social administration、social work or possessing qualification of appointed verified in social administration 、social work as Elementary Rank Civil Service Grade 3 or higher grade”
Article 4
An assistant educator shall meet one of the following qualifications:
1. Possessing a diploma of child care issued by a general or vocational high school or a higher school.
2. Being a graduate of a general or vocational high school or a high school and possessing a certificate of educator training programs.
3. Possessing a diploma of home economics or nursing issued by a general or vocational high school. The person with such qualifications shall be employed as assistant educator within ten years from the date the Regulations are implemented.
4. Being a graduate of a general or vocational high school and possessing a certificate of Program A issued by the Training Programs for Professional Staffs of Child Welfare before the Regulations are implemented. The person with such qualifications shall be employed as educator within ten years from the date the Regulations are implemented.
Article 5
A nanny shall meet one of the following qualifications:
1. Possessing a diploma of child care, home economics or nursing issued by a general or vocational high school or a high school as well as a nanny technician certificate;
2. Being a graduate of a general or vocational high school or a higher school as we as possessing a certificate of training programs for nannies, educators or child care staffs and a nanny technician certificate;
3. Possessing a nanny technician certificate issued before the Regulations are implemented. The person with such qualifications shall be employed as nanny within ten years from the date the Regulations are implemented.
Article 6
An early intervention educator shall meet one of the following qualifications:
1. Possessing an associate’s degree or a higher degree related to nursing, Occupational therapy, physical therapy, education, special education, early intervention, child education, child care, sociology, social work, psychology, consulting, youth and juvenile welfare or home economics or a minor degree related to one of the above fields;
2. Possessing an associate’s degree or a higher degree as well as a certificate of preschool special education programs or early intervention educator training programs;
3. Possessing an associate’s degree as well as being qualified as educator of welfare service for the disabled according to the Regulations Governing Employing and Training Professional Staffs for Providing Welfare Service for the Disabled. The person with such qualifications shall be employed as early intervention educator within ten years from the date the Regulations are implemented.
4. Being a graduate of a general or vocational high school or a higher school and having worked as assistant early intervention educator for three years or more.
5. Being qualified in junior examinations or other equal examinations for civil servants of social administration 、social work or possessing qualification of appointed verified in social administration 、social work as Elementary Rank Civil Service Grade 3 or higher grade.
Article 7
An assistant early intervention educator shall meet one of the following qualifications:
1. Possessing a diploma of child care, home economics or nursing issued by a general or vocational high school or a higher school.
2. Being a graduate of a general or vocational high school or a higher school as we as possessing a certificate of early intervention educator training programs.
3. Being a graduate of a general or vocational high school as well as being qualified as educator of welfare service for the disabled according to the Regulations Governing Employing and Training Professional Staffs for Providing Welfare Service for the Disabled. The person with such qualifications shall be employed as early intervention educator within ten years from the date the Regulations are implemented.
Article 8
A child care staff shall meet one of the following qualifications:
1. Possessing an associate’s degree or a higher degree related to child education, child care, home economics, child and juvenile welfare, social work, psychology, consulting, education, crime prevention, social welfare or gender studies or a minor degree related to one of the above fields;
2. Possessing an associate’s degree or a higher degree as well as a certificate of elementary school teacher programs or educator training programs;
3. Being a graduate of a general or vocational high school or a higher school and having worked as assistant child care staff for three years or more.
4. Being qualified in junior examinations or other equal examinations for civil servants of social administration、social work or possessing qualification of appointed verified in social administration、social work as Elementary Rank Civil Service Grade 3 or higher grade.
Article 9
An assistant child care staff shall meet one of the following qualifications:
1. Possessing a diploma of child care, home economics or nursing issued by a general or vocational high school or a higher school.
2. Being a graduate of a general or vocational high school or a higher school as we as possessing a certificate of child care staff training programs.
3. Being qualified in elementary examinations or other equal examinations for civil servants of social administration、social work .
Article 10
A life consulting staff shall meet one of the following qualifications:
1. Possessing an associate’s degree or a higher degree related to home economics, nursing, child and juvenile welfare, child education, child care, social work, psychology, consulting, education, crime prevention, social welfare or gender studies or a minor degree related to one of the above fields;
2. Possessing an associate’s degree or a higher degree as well as a certificate of life consulting staff training programs;
3. Being a graduate of a general or vocational high school or a higher school and having worked as assistant life consulting staff for three years or more.
4. Being qualified in junior examinations or other equal examinations for civil servants of social administration、social work or possessing qualification of appointed verified in social administration、social work as Elementary Rank Civil Service Grade 3 or higher grade.
Article 11
An assistant life consulting staff shall meet one of the following qualifications:
1. Possessing a diploma of home economics or nursing issued by a general or vocational high school or a higher school.
2. Being a graduate of a general or vocational high school or a higher school as we as possessing a certificate of life consulting staff training programs.
Article 12
A psychological consulting staff shall meet one of the following qualifications:
1. Possessing an associate’s degree or a higher degree related to psychology, consulting or consultation or a minor degree related to one of the above fields;
2. Possessing an associate’s degree or a higher degree related to social work, child and juvenile welfare, social welfare, education or gender studies as well as a diploma of psychological consulting staff training programs.
Article 13
A social worker shall meet one of the following qualifications:
1. Being qualified in the social worker examination;
2. Possessing an associate’s degree or a higher degree related to social work, child and juvenile welfare or social welfare or a minor degree related to one of the above fields;
3. Possessing an associate’s degree or a higher degree and a certificate of Program D issued by the Training Programs for Professional Staffs of Child Welfare before the Regulations are implemented. The person with such qualifications shall be employed as social worker within ten years from the date the Regulations are implemented;
4. Being qualified in senior examinations or other equal examinations for civil servants of social administration、social work.
Article 14
A superintendent of a nursery institute shall meet one of the following qualifications:
1. Possessing a master’s degree or a higher degree related to child education or child care and having worked in nursery institutes or kindergartens for two years or more.
2. Possessing a bachelor’s degree related to child education or child care or a minor degree related to the above filed, being qualified as educator, having worked in nursery institutes or kindergartens for two years or more as well as possessing a certificate of superintendent training programs.
3. Possessing a bachelor’s degree, being qualified as educator, having worked in nursery institutes or kindergartens for three years or more as well as possessing a certificate of superintendent training programs.
4. Possessing an associate’s degree, being qualified as educator, having worked in nursery institutes or kindergartens for four years or more as well as possessing a certificate of superintendent training programs.
5. Being a graduate of a general or vocational high school, being qualified as educator, having worked in nursery institutes or kindergartens for five years or more as well as possessing a certificate of Program E issued by the Training Programs for Professional Staffs of Child Welfare before the Regulations are implemented. The person with such qualifications shall be employed as superintendent of a nursery institute within ten years from the date the Regulations are implemented.
6. Being qualified in senior examinations or other equal examinations for civil servants of social administration、social work and having worked in nursery institutes for two years or more.
The work experiences in nursery institutes or kindergartens in the preceding paragraph shall be verified by the years of service certificated issued by the competent or education authorities of the municipality, county or city governments.
Article 15
A superintendent of an early intervention institute shall meet one of the following qualifications:
1. Possessing a master’s degree or a higher degree related to child and juvenile welfare, child education, child care, social welfare, social work, psychology, consulting, special education or early intervention and having worked in private or public social welfare institutes for two years or more.
2. Possessing a bachelor’s degree related to child and juvenile welfare, child education, child care, social work, psychology, consulting, special education, having worked in private or public social welfare institutes for two years or more as well as possessing a certificate of superintendent training programs.
3. Possessing a bachelor’s degree, meeting one of the qualifications prescribed in Article 3, 6, 8, 10, 12 or 13 of the Regulations, having worked in private or public social welfare institutes for three years or more as well as possessing a certificate of superintendent training programs.
4. Possessing an associate’s degree, meeting one of the qualifications prescribed in Article 3, 6, 8, 10, 12 or 13 of the Regulations, having worked in private or public social welfare Institutes for four years or more as well as possessing a certificate of superintendent training programs.
5. Being qualified in senior examinations or other equal examinations for civil servants of social administration、social work and having worked in private or public social welfare institutes for two years or more.
6. Being qualified as physician, therapy, psychologist or special education teacher, having worked in private or public social welfare institutes for three years or more as well as possessing a certificate of superintendent training programs.
Article 16
A superintendent of a placement and education institute shall meet one of the following qualifications:
1. Possessing a master’s degree or a higher degree related to child and juvenile welfare, social work, psychology, consulting, education, crime prevention, home economics or social welfare and having worked in private or public social welfare institutes for two years or more.
2. Possessing a bachelor’s degree related to child and juvenile welfare, social work, psychology, consulting, education, crime prevention, home economics or social welfare or a minor degree related to the above fields, having worked in private or public social welfare institutes for two years or more as well as possessing a certificate of superintendent training programs.
3. Possessing a bachelor’s degree, meeting one of the qualifications prescribed in Article 3, 6, 8, 10, 12 or 13 of the Regulations, having worked in private or public social welfare institutes for three years or more as well as possessing a certificate of superintendent training programs.
4. Possessing an associate’s degree, meeting one of the qualifications prescribed in Article 3, 6, 8, 10, 12 or 13 of the Regulations, having worked in private or public social welfare institutes for four years or more as well as possessing a certificate of superintendent training programs.
5. Being a graduate of a general or vocational high school, being qualified as educator, having worked in nursery institutes or kindergartens for five years or more as well as possessing a certificate of Program F issued by the Training Programs for Professional Staffs of Child Welfare before the Regulations are implemented. The person with such qualifications shall be employed as superintendent of a placement and education institute within to ten years from the date the Regulations are implemented.
6. Being qualified in senior examinations or other equal examinations for civil servants of social administration、social work and having worked in private or public social welfare institutes for two years or more.
7. Being qualified as physician, nurse, psychologist or teacher, having worked in private or public social welfare institutes for three years or more as well as possessing a certificate of superintendent training programs.
Article 17
A superintendent of a psychological consulting or family consultation institute shall meet one of the following qualifications:
1. Possessing a master’s degree or a higher degree related to child and juvenile welfare, social work, psychology, consulting, education, crime prevention, home economics or social welfare and having worked in private or public social welfare institutes for two years or more.
2. Possessing a bachelor’s degree related to child and juvenile welfare, social work, psychology, consulting, education, crime prevention, home economics or social welfare or a minor degree related to the above fields, having worked in private or public social welfare institutes for two years or more as well as possessing a certificate of superintendent training programs.
3. Possessing a bachelor’s degree, meeting one of the qualifications prescribed in Article 3, 6, 8, 10, 12 or 13 of the Regulations, having worked in private or public social welfare institutes for three years or more as well as possessing a certificate of superintendent training programs.
4. Possessing an associate’s degree, meeting one of the qualifications prescribed in Article 3, 6, 8, 10, 12 or 13 of the Regulations, having worked in private or public social welfare institutes for four years or more as well as possessing a certificate of superintendent training programs.
5. Being a graduate of a general or vocational high school, being qualified as educator, having worked in nursery Institutes or kindergartens for five years or more as well as possessing a certificate of Program F issued by the Training Programs for Professional Staffs of Child Welfare before the Regulations are implemented. The person with such qualifications shall be employed as superintendent of a psychological consulting and family consultation institute within ten years from the date the Regulations are implemented.
6. Being qualified in senior examinations or other equal examinations for civil servants of social administration、social work and having worked in nursery, child placement and education or psychological consulting and family consultation institutes or other institutes for two years or more.
7. Being qualified as physician, nurse, psychologist or teacher, having worked in private or public social welfare institutes for three years or more as well as possessing a certificate of superintendent training programs.
Article 18
A professional staff employed according to Subparagraph 4 of Article 3, Subparagraph 5 of Article 6, Subparagraph 4 of Article 8, Subparagraph 3 of Article 9, Subparagraph 4 of Article 10, Subparagraph 4 of Article 13, Subparagraph 6 of Paragraph 1 of Article 14, Subparagraph 5 of Article 15, Subparagraph 6 of Article 16 and Subparagraph 4 of the preceding article shall obtain a certificate of training programs of such professional staffs.
Article 19
Professional training programs for nannies and child-care, life consulting and psychological consulting staffs, superintendents, educators, social workers shall include the following core courses:
1. Laws and regulations related to child and juvenile welfare.
2. Child development
3. Family supports and social resources.
4. Parent education
5. Professional work ethics
6. Other courses related to child and juvenile services.
For the person taking courses in different training programs, if the course titles are identical, he/she can be exempted from re-taking the same course.
Article 20
The competent authorities shall hold training programs of professional staffs related to the Regulations or appoint colleges or universalities with related programs or courses to hold such programs. With the approval of the central competent authority, the competent authorities may appoint groups which deal with child and juvenile welfare affair to hold such programs if necessary.
The personal qualifies in the training programs shall be issued a diploma recording the titles and the training hours of courses taken by the competent authorities. The form of the certificate shall be established by the competent authority.
Article 21
Professional staffs of Institutes shall participate in in-service and orientation trainings.
Article 22
Orientation trainings shall include orientations to the environment, the service scope and the management system of the institute as well as laws and regulations concerned.
Article 23
There shall be 20-hour or more in-service trainings annually. The training programs shall include both theories and practices.
Article 24
In-services trainings should be carried our pursuant to the followings:
1. The competent authorities hold the trainings, or appoint/subside other Institutes or groups to hold the trainings.
2. The Institutes hold the trainings on their own, or appoint other Institutes or groups to hold the trainings.
3. The competent authorities of the target business hold the trainings.
Article 25
Professional staffs who participate in in-service trainings shall be give office leave.
Article 26
Professional staffs, except for the ones prescribed in Subparagraph 2 of Article 4 of the Regulations, who possess diplomas issued according to the Training Programs for Professional Staffs of Child Welfare before the Regulations are implemented are deemed to have completed the core courses prescribed in the Regulations.
Article 27
The person who has acquired the professional staff qualifications according to the Regulations Regarding Qualifications of Child and Juvenile Welfare Professional Staffs before the Regulations are implemented and has been in service of the same job in the same institute shall be deemed as a qualified professional staff prescribed in the Regulations.
If the person in the preceding paragraph transfers to another job or institute, he/she shall acquire relevant qualifications pursuant to the Regulations.
Article 28
Institutes locating in uplands, remote, islands or aborigine regions or accepting HIV positive children and juveniles, if encountering difficulties in recruiting professional staffs, may report such difficulties to the competent authorities of the municipality, county or city governments. With the approval of the central competent authority, the qualifications of professional staffs may be loosened.
Article 29
The Regulations shall be implemented from the announcement date.
