Directions Governing Applications for the Establishment of International Non-Governmental Organizations(國際性民間團體申請設立要點)

1.The Directions are established to facilitate applications by citizens of the Republic of China for establishing international non-governmental organizations within the territory of the Republic of China. 2.Unless otherwise provided by law, all applications for the establishment of international non-governmental organizations shall be subject to the Directions. 3.The term “international non-governmental organizations”, as used herein, shall refer to transnational organizations that are established to promote culture, academic studies, medical care, health, religions, benevolence, physical education, social events, social services, or other public interest purposes among people of the world. 4.The registration authority set forth herein is the Ministry of the Interior, which is responsible for processing all applications for the establishment of international non-governmental organizations. The practices engaged in by each international non-governmental organization shall be supervised by the authority in charge of relevant businesses. 5.If any international non-governmental organizations that apply for establishment within the Republic of China share the same name, only one of them will be allowed. Such organizations must not engage in activities that violate the Constitution of the Republic of China, advocate for communism, or support secession of the territory of the Republic of China. 6.The constitution of an international non-governmental organization shall contain the following: I.The name, objectives, tasks, and organization thereof; II.The premises; III.The affiliation, disaffiliation, dismissal, rights, and obligations of members; IV.The name, quota, authority, tenure, appointment, and removal of member representatives and appointed personnel; V.Funding and accounting; VI.Procedures for amending the constitution; VII.The principal office thereof shall be located in the Republic of China; in case of relocation to outside the Republic of China, the organization shall be deemed as having been automatically cancelled. 7.To apply for establishment, an international non-governmental organization shall submit the following documents in quadruplicate to the competent authority for recording purposes; if such documents are written in foreign languages, four copies of the Chinese translation shall be submitted; I.An application form (refer to Appendix 1); II.The constitution; III.A list of members (refer to Appendix 2); i.The members shall be organizational members only; ii.The applying organization shall consist of organizations that have been approved, registered, or recorded according to the laws of their respective countries: a global organization shall consist of five or more organizations that are located in three or more continents; an Asia-Pacific regional organization shall consist of three or more organizations that are located in different countries in the Asia-Pacific Region. IV.The registration certificate of a national organization that is approved by and registered with the competent authority of the Republic of China; V.The work plan of the principal office of an international non-governmental organization (refer to Appendix 3) shall contain the following: i.The address and telephone number; ii.Work items; iii.The organization and responsibilities; ivSources of funding. VI.The resume of the head and staff of an international non-governmental organization (refer to Appendix 4) shall contain the following: I.The position title; II.The name, gender, and date of birth; III.The nationality; IV.Education and work experience; V.ID card number, alien resident certificate number, or passport number; VI.The residence or domicile (or the residence address indicated on the alien resident certificate in the case of foreigners). 8.An international non-governmental organization that has submitted the aforesaid documents to the competent authority for recording purposes shall, within a month before (or after) the end of each year, submit an annual work plan and budget plan (or a work report and final account statement) to both the competent authority and the authority in charge of relevant businesses for recording purposes. 9.In the event that any international non-governmental organization violates the law of the Republic of China or the constitution thereof or adversely affects public interest, the competent authority may impose a disposition in accordance with applicable regulations. The aforesaid disposition may also be imposed by the authority in charge of relevant businesses after consulting the competent authority.
