Directions Governing Application and Using for Immigration e-Gate

1.  In order to accept the application and usage of e-Gate by appointed travelers, to complete immigration clearance, and to collect travelers’ data, the present direction is hereby enacted by law.

2.  e-Gate applicants (hereinafter referred to as “applicants”) should be at least 12 years old, and 140 centimeters in height. Meanwhile, applicants should meet the following qualifications:
2-1. Nationals with household registration in Taiwan Area (hereinafter referred to as “Registered Nationals”).
2-2. Nationals without household registration (hereinafter referred to as “Non-registered Nationals”) have acquired residency of Taiwan Area.
2-3 Aliens have acquired residency or permanent residency of Taiwan Area
2-4. Aliens have acquired diplomatic identity card issued by the Ministry of Foreign Affairs (hereinafter referred to as “MOFA Card”) or certain identity documents issued by certified international organizations.
2-5. Hong Kong and Macao residents have acquired residency of Taiwan Area.
2-6. People of Mainland Area have acquired Multiple Resident Exit & Entry Permit, both eligible for long-term residency and spouse residency.
2-7. Foreign frequent visitors of specific nationality have acquired Speedy Immigration Inspection Certificate (hereinafter referred to as “Speedy Certificate”). The qualification of specific nationality will be later announced by National Immigration Agency.
2-8. Aliens qualified by treaty, by agreement, or by the interests of our nation as well as the Principle of Reciprocity.

3-1. To enroll e-Gate, applicants shall leave their signature and fingerprints on the application form at the locations assigned by National Immigration Agency, and bring along the original copy of following valid documents:
3-1-1. Registered Nationals: Valid passport. For nationals registered in Kinmen, Matsu and Penghu may submit original and valid Entry & Exit Permit (via Kinmen, Matsu, and Penghu) instead.
3-1-2. Non-Registered Nationals with residency:
3-1-2-1. Resident Certificate of Taiwan Area.
3-1-2-2. Valid Passport.
3-1-3. Aliens with residency:
3-1-3-1. Resident Certificate with Multiple Re-entry permit, or Permanent Resident Certificate.
3-1-3-2. Valid Passport issued by other Nations.
3-1-4. Aliens with MOFA Card or certain identity documents issued by certified international organizations.
3-1-4-1. MOFA Card or certain identity documents issued by certified international organizations.
3-1-4-2. Valid Passport issued by other Nations.
3-1-5. Hong Kong and Macao residents with residency of Taiwan Area.
3-1-5-1. Resident Certificate of Taiwan Area with Multiple Entry & Exit Permit.
3-1-5-2. Hong Kong SAR Passport, Macao SAR Passport, BNO passport issued by The United Kingdom of Great Britain and Northern Ireland, and Portuguese Passport under certain conditions. (Such Portuguese Nationality must be acquired before December 19th, 1999, the date Portugal ended its rule over Macao.)
3-1-6. People of Mainland Area with residency
3-1-6-1. Spouse Resident Certificate or Long-term Resident Certificate with Multiple Entry & Exit Permit.
3-1-6-2. Taiwan Travel Permit for People of Mainland Area or PRC Passport.
3-1-7. Foreign Frequent Visitors have acquired Speedy Certificate which has been published as a notice by National Immigration Agency.
3-1-7-1. Speedy Certificate.
3-1-7-2. Valid Passports mentioned in this paragraph.
3-1-8. Aliens who are qualified by treaty, by agreement, or by the Principle of Reciprocity. The above-mentioned nationalities shall meet the list of Visa-exempted countries or the list of Visa-required countries.
3-1-9. For the above-mentioned applicants, National Immigration Agency may request other supplementary documents for further detail review.
3-2. Passports listed in the preceding paragraph shall be electronic Machine Readable Travel Document (eMRTD) as ICAO defines, unless the applicant has acquired residency or permanent residency of Taiwan Area.
3-3. Under the purpose of identity verification, National Immigration Agency may request further detail information from other authorities which are not subordinated to us.
3-4. Qualified applicants by the above-mentioned 3-1-1, 3-1-2, 3-1-3, 3-1-5, and 3-1-6, may enroll the system by the self-help instruction while the first time usage.

4-1. The allotted time period for applicants mentioned in Paragraph 2 are as follows:
4-1-1. For applicants listed in subparagraph 2-2, 2-3, 2-5, and 2-6, the period is the same as the validity of their residency.
4-1-2. For applicants listed in subparagraph 2-4, the period is the same as the validity of MOFA Card or the validity of identity documents issued by certified international organizations.
4-1-3. For applicants listed in subparagraph 2-7, the period is the same as the validity of Speedy Certificate.
4-1-4. For applicants listed in subparagraph 2-8, the period is noted as in the treaty, the agreement, or the Principle of Reciprocity.
4-2. The applications should be renewed once the applicants has acquired residency, permanent residency or naturalized. For applicants who are applicable according to subparagraph 2-8, and who pay for such application, the application may not be renewed.
4-3. For users who are required to complete Arrival Card on arrival, entries shall be processed and submitted online every time before e-Gate usage.

5.  e-Gate usage is prohibited once applicants are within any of the following circumstances:
5-1. Prohibited from exiting the State / Taiwan Area by law.
5-2. Registered nationals have left the State / Taiwan Area for more than 2 years. Such migration will cause one’s registration removed.
5-3. Unable to use e-Gate by one’s self.
5-4. Draftees, servicemen, or personnel related to national security or confidential matters are not granted with permission to exit the State / Taiwan Area. They are prohibited as well when certain permissions have failed to transmit to the National Immigration Agency.
5-5. Arrival Cards has not been completed as well as submitted online, for those requested to do so.
5-6. A resident Visa is obtained in beforehand for applicants listed in subparagraph 2-8.

6-1.  During application of e-Gate, personal data will be recorded by the National Immigration Agency.
6-2. Personal data referred in preceding paragraph 6 shall be both facial image and index fingerprints.  Applicants with injuries or marks on the face may only have their fingerprints recorded. Applicants with finger injures may record other fingers instead. Thumbs, middle fingers, ring fingers and little fingers are the sequence.
6-3. Application of registered nationals may record only facial images.
6-4. Renewal according to subparagraph 4-3., National Immigration Agency shall remove the previous  application  from the system.

7-1. During the usage of e-Gate, applicants shall present and scan their valid travel documents according to their identity:
7-1-1. Nationals: valid R.O.C. passport or Entry & Exit Permit
 (via Kinmen, Matsu, and Penghu).
7-1-2. Aliens: foreign passport, Resident Certificate with Multiple Re-entry permit, or Permanent Resident Certificate.
7-1-3. Hong Kong and Macao residents: Resident Certificate of Taiwan Area with Multiple Entry & Exit Permit, or foreign passport listed in 3-1-5-2.
7-1-4. People of Mainland Area: Spouse Resident Certificate or Long-term Resident Certificate with Multiple Entry & Exit Permit.
7-2. Applicant failed to clear immigration by e-Gate shall be inspected by manual inspection.

8. Notices for e-Gate usage:
8-1. No sunglasses, hat, or mask that cover user’s face.
8-2. Present and scan the exact same travel document as in application.
8-3. The applicant may ask for immigration clearance stamp after using e-Gate. Please approach Diplomat/ Official/ Crew counter for stamp once clear immigration.

9. NIA shall comply with the Personal Information Protection Act, Regulations Governing the Collection, Management, and Use of Individual Biometric Data, and other lawful regulation to collect and record  facial image or fingerprints.

10.  NIA shall announce the details about the setup, the qualification, and required documents of e-Gate in stages.
