Administrative Guidelines of Applying for Approval of Overseas Green Building Label

 

For extensively promoting the effect of the Green Building Label, the  Ministry of the Interior (hereinafter referred to as the MOI) has formulated the Operation Directions to encourage the adoption of green building of ecology, energy saving, waste reduction, and health overseas for any countries located in the area with hot and humid climatic condition, so as to achieve a comfortable, healthy, and environmentally-friendly living environment.

Terminology and definition:

Green Building Label: The Label certified by the MOI for any specific complete building or community located outside the Taiwan Area that has acquired the building use permit or been legally identified by its local government, and is capable of complying with the Green Building Evaluation System.

Green Building Candidate Certificate: The Certificate certified by the MOI for any specific building or community or project located outside the Taiwan Area that has acquired the building permit, or been under construction, or been a legal existing one, and is capable of complying with the Green Building Evaluation System.

Applicant: An applicant shall be the building developer, owner, or occupant.

Evaluation Manual for Overseas Green Buildings: The Manual published by the Architecture and Building Research Institute of the MOI for overseas green building evaluation.

Green Building Classification: According to the rating method formulated in the Evaluation Manual for Overseas Green Buildings, the classification system consists of five classes: Certified, Bronze, Silver, Gold, and Diamond.

The applicant shall apply online for the Green Building Label or Green Building Candidate Certificate through the internet with the submission of the completed application form for certification and a valid evaluation report that the day of issuance is within a year prior to the application date that are both duly provided. The Label or Certificate will be conferred as the application passes the examination.

     With regard to the evaluation report for Green Building Label or Green   Building Candidate Certificate set forth in the preceding paragraph, the applicant shall apply to the Professional Evaluation Organization for Green Building Label designated by the MOI (hereinafter referred to as the PEO) with necessary documents for green building evaluation.

     As regards the certified application that may need further supplementation and rectification, the applicant shall provide supplementary documents within twenty days from the date of receiving the notice. In case of being unable to provide supplementary documents within twenty days, the applicant may    request the extension with relevant statements. The extension may be granted for a period not exceeding twenty days. With no supplementary documents received at the expiry date, the application  will be rejected.

 

The application form for certification shall specify the following particulars:

For the applicant is a natural person, the application form shall specify applicant’s name, postal address, contact phone numbers, and signature. For the applicant is a juridical person or an organization, the application form shall specify the name of the legal entity or organization, company’s tax ID number, postal address, contact phone numbers, signature, and the name of its legal representative.

The building’s name, site area, total floor area, and the extent of the site. For the type of community, the application form shall specify the community’s name, area, extent, and population estimation.

The version of the Evaluation Manual for Overseas Green Building and its green building class.

The name of the PEO and its phone numbers.

The evaluation report shall specify the following particulars:

Report number and the evaluation date..

Name of the PEO and its legal representative, evaluation committee members and their signatures.

Name of building or community and an overview.

The version of the Evaluation Manual for Overseas Green Buildings and its green building class.

Evaluation report summary of the application case.

Evaluation criteria, results, and the evaluation meeting minute.

Notices.

Other supplementations.

The evaluation criteria and requirements for overseas Green Building Label or Green Building Candidate Certificate shall be based on the Evaluation Manual for Overseas Green Buildings.

     Matters not prescribed in the Evaluation Manual for Overseas Green Buildings, the evaluation committee of the PEO may draw a conclusion and report same to the MOI for future reference.

 

The processing time of the application case for the PEO is prescribed as follows.

As the application case for Green Building Candidate Certificate is registered, the PEO shall complete the evaluation with the evaluation report duly prepared within fifty days.

As the application case for Green Building Label is registered, the PEO shall complete the evaluation with the evaluation report duly prepared within sixty days.

The processing time of evaluation set forth in the preceding paragraph is exclusive of on-site investigation time. The on-site investigation shall be completed within thirty days.

With regard to the application case that needs further supplementation and rectification, the PEO shall notify the applicant to complete the supplementation and rectification within thirty days from the date receiving the notice. In case of being unable to provide supplementary documents within thirty days, the applicant may request the extension with relevant statements, which extension period cannot exceed thirty days. With no supplementary documents received at the expiry date, the application will be rejected. The supplementation and extension time is included in the processing time of evaluation.

 

The validity of the Green Building Label or Green Building Candidate Certificate is five years. Within one to five months prior to the expiry, the applicant may submit the application form and the evaluation report according to its original version of evaluation manual, which report date shall be within one year from the application date, to apply for extension of certification. For a building or community project or a newly constructed building certified with Green Building Candidate Certificate, its candidate certificate becomes invalid once it acquires the Green Building Label.

    The application for extending the certification of Green Building Label or Green

     Building Candidate Certificate shall comply with Article 3.

 

As the project acquiring the Green Building Candidate Certificate changes its passed indicators or class during its construction period, the applicant of the Candidate Certificate may submit relevant documents and drawings to the PEO to apply for the evaluation and file with the evaluation results to apply to the MOI for certification afterwards.

As the building or community acquiring the Green Building Label changes its     passed indicators or class during its operation/utilization period, the owner or occupant of the building or community may submit the consent of the original applicant of the Label and relevant documents and drawings prescribed in Article 3 to the PEO to apply for the evaluation and file with the evaluation results to apply to the MOI for certification afterwards.

 

The PEO may invite scholars, exports, relevant organization, and the applicant to carry out an on-site investigation while evaluating relevant documents of Green Building Label applications.

For the application of the Label set forth in the preceding paragraph, the MOI may conduct a checking/verification work as needed.

 

The MOI or the PEO may conduct a random check and investigation aperiodically on the building/community/project with the Green Building Label or Green Building Candidate Certificate. For the building/project unable to meet the required indicators specified on the Label or the Candidate Certificate, the MOI or PEO shall ask for the improvement within thirty days. If the improvement is unable to be finished within thirty days due to special circumstances, the building or community owner, occupant, or applicant submit relevant statements and affidavit to apply for the extension within a period not exceeding thirty days.

The building/community/project is unable to finish the improvement in good time or to meet the requirements of indicators after improvement, the MOI may cancel its Label or Candidate Certificate and announce on the green building website of the MOI (http://www.abri.gov.tw) and notify the original applicant, building/community owner, or occupant of the Label or Candidate Certificate.

 

The logo the Green Building Label has been registered and announced by the MOI according to the applicable laws and regulations. For the tort or unauthorized copyright infringement of the Green Building Label or Green Building Candidate Certificate, the MOI shall announce the tortfeasor and the name of the building or community and claim the damage compensation in civil litigation and the doer shall be prosecuted for criminal responsibility in accordance with the law.

The Green Building Label or Green Building Candidate Certificate shall specify the name of the building or community, a brief summary of the building or community, valid period, the version of evaluation manual for overseas green buildings, and its green building class.

In case of the loss or breakage, the applicant can apply to the MOI for the reissuance with the reason statement.

The application case is certified by the MOY according to the application form and evaluation report submitted by the application. The MOI may cancel the certified Label or Candidate Certificate in following cases:

The building permit is terminated or revoked by the local authority.

Forgery.

Submission of false information or evidence.

Trespassing another’s property or causing dangers or injuries.
